Failure to renew by December 31, 1999 will result in a $150 late fee per month or portion of a month
Continuing education units ARE required for this renewal
By December 31, 1999, all licensees will be required to have a total of 40 hours of continuing education. Six of these hours must be in the area of diagnostic imaging. There are no other requirements related to continuing education for relicensure in 2000.
Continuing Education Approvals
The Board is currently promulgating rules regarding the Board's procedures in approving continuing education programs. Until then, you are hereby notified that the approval of such programs is based on the language in the law, and does not constitute endorsement or any philosophical position of the Board regarding the approval of any particular subject matter. Use of any procedures, devices or techniques which are either substandard, or which result in substandard care to the patient are not permitted. The defense that they were learned in the context of a continuing education program will not mitigate a doctors responsibility to provide appropriate care.
Are you not getting CE credit...?
The MBCE carries only your legal name. Be sure when you register at seminars and when you sign in, you do so with the name the Board has on file for you. You must include "Jr" or "Sr" as appropriate, and not use nicknames. Finally, if you are newly married and are using a married name, you must officially change your name with the Board. Legal documentation will be necessary to make such a change.
HOW MANY CE's DO I HAVE?
All information for continuing education credits must come from the sponsor directly, not from the individual doctor. All doctors will receive a report of their CE credits with renewal the materials mailed in October. We are currently in the process of adding all CE hours into our new computer system. If you do not know how many CE hours you have you may call the Board office between 8 a.m. and 10 a.m. ONLY. This information will be included in the packet in October.
Have You Moved?
All licensees are required to notify the Board within 30 days of changing their address. The Board will be mailing renewal materials to the address currently on file. These materials will be mailed during approximately the second week in October. If you have changed your address, please contact the Board in writing immediately. Failure to renew as a result of delays in receiving materials due to a change in address will not be sufficient grounds to avoid penalty fees.
IMPORTANT NOTICE ON CONTINUING EDUCATION REQUIREMENTS
Due to some recent changes in legislation, as well as a board action taken on April 29, 1999, the MBCE will no longer be requiring continuing education in the area of infection control. This change is effective immediately. Any CE taken which included infection control will still be counted toward your total number of required hours.

BUGS
Unlike other models of health care, chiropractic is a little less concerned about "bugs" that might affect people. However, even we must give in to the Year 2000 (Y2K) "bug." Accordingly, the Board has been involved in the upgrading of computer systems including hardware and software. This process has taken nearly a year and a half and has often been trying and difficult. However, in any difficult situation there is opportunity. Some benefits to practitioners which may occur as a result of the upgrade are future possibilities such as online renewals, online continuing education status review, and others. Please look for a survey in your renewal materials to help the board in development of future possibilities.
RULES...
For the past few years the Board has been working on the promulgation of several Board Rules regarding the practice of Chiropractic. The state of Minnesota has a structured rules promulgation process with specific procedures and timelines. The timelines are such that occasionally they do not accommodate or coincide with the Board meetings to discuss these rules. However, currently we have several rules that have missed some of these timelines in the process and the only way to get them back on track is to start the process from the beginning.
We will continue to inform you of the rules in process in this newsletter. Or if you wish you may be placed on a "Rules List" where we would send you frequent mailings of the rules and where they are in the process by calling our office at 612-617-2225.
Rules that have been published for Notice of Intent to Adopt without a public hearing:
Proposed Rules Governing Waivers and Variances, Minnesota Rules, 2500.5050 Subp. 1-5.
AND
Proposed Rules Governing Acupuncture - Dual Registration, Minnesota Rules, 2500.3000 Subp.6.
Introduction. The Minnesota Board of Chiropractic Examiners intends to adopt rules without a public hearing following the procedures set forth in the Administrative Procedure Act, Minnesota Statutes, sections 14.22 to 14.28, and rules of the Office of Administrative Hearings, Minnesota Rules, parts 1400.2300 to 1400.2310. A notice of Intent to Adopt was published in the State Register on August 9, 1999.
Agency Contact Person. Comments or questions on the rules and written requests for a public hearing on the rules must be submitted to the agency contact person. The agency contact person is: Larry Spicer at Minnesota Board of Chiropractic Examiners 2829 University Avenue S.E. #300, Mpls., MN 55414, phone: 612-617-2225 and FAX 612-617-2224 or email at .
Subject of Rules and Statutory Authority. The proposed rules are about Waivers and Variances. A person subject to the rules of the board may request that the board grant a variance from any rule of the board. The statutory authority to adopt the rule is Minnesota Statutes, section 148.08, Subd. 3. And with regard to Acupuncture - Dual Registration any doctor of chiropractic who is separately registered according to Minnesota Statutes, chapter 147B, is exempt from subparts 2 and 5. A copy of the proposed rules is published in the State Register.
Comments. A Notice of Intent to Adopt was posted in the August 9, 1999 State Register allowing for comments to be made in support or opposition. This period closed on September 8, 1999.
Alternative Format. Upon request, this Notice can be made available in an alternative format, such as large print, Braille, or cassette tape. To make such a request, please contact the agency contact person at the address or telephone number listed above.
Modifications. The proposed rules may be modified as a result of public comment. The modifications must be supported by comments and information submitted to the agency, and the adopted rules may not be substantially different than these proposed rules. If the proposed rules affect you in any way, you are encouraged to participate in the rulemaking process.
Statement of Need and Reasonableness (SONAR) A statement of need and reasonableness is now available from the agency contact person. This statement contains a summary of the justification for the proposed rules, including a description of who will be affected by the proposed rules and an estimate of the probable cost of the proposed rules. Copies of the statement may be obtained at the cost of reproduction from the agency.
Adoption and Review of Rules. If no hearing is required, the agency may adopt the rules after the end of the comment period. The rules and supporting documents will then be submitted to the Office of Administrative Hearings for review for legality. You may ask to be notified of the date the rules are submitted to the office. If you want to be so notified, or want to receive a copy of the adopted rules, or want to register with the agency to receive notice of future rule proceedings, submit your request to the agency contact person listed above.
Withdrawn Rules
A Notice of Withdrawal of Proposed Amendments to Minnesota Statute 148.08, Relating to Experimental Procedures
Notice was given that the proposed amendments to Minnesota Statute 148.08 as published on December 27, 1993 at 1576 State Register are withdrawn. Dated: July 1, 1999.
BOARD MEETING UPDATE
Action taken by the MBCE at its July, 15, 1999 meeting include:
An announcement was made regarding a staffing change in the office; John Burbey is the new License Coordinator, Becky Elmasry was the previous coordinator.
A draft of a new take home Jurisprudence Examination was presented to the Board. The Board will see the final draft at the next meeting.
Action taken by the MBCE at its September 16, 1999 meeting include:
Administrative Procedures - are being reviewed and worked on by the Executive Committee. A final draft should be able to be presented to the Board at the February meeting for final approval.
Computer Update - The Board office is currently in an intensive testing phase of the new computer application system for compliance with Y2K procedures.
The Board's Assistant Attorney General is reviewing Dr. Spicer's version of the take home Jurisprudence Examination draft. A motion was made by the Board to accept this final draft of the examination.
The Governor's office has made an official announcement to renew the appointments of Board members Dr. LeRoy Otto, and Public member Joan Patalonis. Their appointments are through 2003.
