Renewal season is complete
until August 2002. The online
implementation was a marked success for state government operations. Post renewal season activity on the web is
limited to the two following options:
LOOK UP PUBLIC INFORMATION / LICENSE STATUS
To access these pieces of
the web online system go to the Board’s website at
and click on either “Locate
a Doctor – Public Access” or “Online Renewal & Information Changes”. If you are a licensed doctor logging in to
make changes, you must select your appropriate registration type and enter the
requested information to enter the system.
Licensees are encouraged to
enter the system now and become familiar with it to prepare for next year’s
renewal season. Actual license and
registration renewal forms are available online only during open renewal
periods as described below:
Acupuncture Registration: August 15 – September 15 (each year)
DC Licenses:
October 15 – December 31 (each year)
Professional Firms:
October 15 – December 31 (each year)
Independent Examiners Registration: January 31 – February 28 (each year)
The
Board anticipates continued modifications to its database, processes, and forms
to best meet the needs of information gathering, protection of the public, and
efficient use of licensee funds.
Questions and comments about
the system may be sent to the Board and will be considered as we prepare for a
new round of upgrades and improvements between now and August 15, 2002.
Effective immediately,
licensees are STRONGLY ENCOURAGED to begin acquiring and maintaining
receipts of participation in continuing education programs directly from the CE
providers. This should be done in anticipation of rule amendments, which, while
not yet completed, may be adopted and put into effect before the end of this
year. Licensees SHOULD NOT construe this to mean that any amendments are
currently in place. This notice is only to prepare you in case such changes are
completed prior to license renewal.
The
MBCE has not raised license fees for the past ten years. However, during this last twelve months
several things have happened that may have a future impact on fees. For example, the recent state and federal
fraud investigations may result in contested case hearings to revoke or take
away licenses from a number of practitioners.
Such investigations, and related procedures, are very expensive. These
costs are borne by the profession. This is a perfect example of the entire
profession being impacted by the actions of a very few.
Although
costs will be passed on to licensees at some point, the law allows the Board to
collect fees at a rate that does not “substantially over or under recover” the
costs of operation. What this means is
that the cost of these cases may be spread out over a number of years; may be
collected by a single or series of “special assessments”; and/or a combination
of the two. State government is designed
to help ensure that these costs are not excessive by requiring that the amount
of any increase or special assessment must be submitted to multiple levels of
oversight, including the Legislature. The Board wants all licensees to know
that: (1) it is working hard to
control these costs; (2) it
attempts to reach fair settlements from disciplined licensees; and (3) it
wishes to impart to practitioners that early reporting of practice violations
with substantive evidence can help to keep these costs down.

The Board continues to work on the promulgation of Rules
regarding the practice of chiropractic.

BOARD MEETING UPDATE
Action taken by the MBCE at its
ü
The online renewal system was demonstrated for
Board members.
ü
Future legislative needs were discussed.
ü
Discussion occurred regarding the MBCE budget and
the impact of contested case expenses in the form of Attorney General costs
along with a possible need to raise fees or make a special assessment in the
future.
ü
The Board approved a motion to pursue
legislative efforts to: *improve the
definition of fee splitting and use of incentives to acquire patients; and
*require that ownership of a practice be limited to doctors of chiropractic.
ü
A report was given on the process used for
granting transfer licenses.
ü
The Board withdrew its authorizing resolution for
the Doctor Patient Relationship rule.
ü
The Board authorized new rulemaking on:
*Amending the Definition of Chiropractic Practice; and *Defining Sexual
Misconduct.
ü
Election of board officers resulted in the

A plaque was presented to outgoing Board Member,
John Colvard DC.

An update was given on legislation affecting the
Board and a vote resulted in the Board expressing a desire to not become the
regulatory board for massage therapists.
ü
Dr. Spicer reported that 266 people had
successfully used the online renewal system.
ü
Dr. Otto reported on the FARB Forum.
ü
An announcement was made regarding the next
Rules Committee Meeting.
ü
Ms. Kassekert reported on activities of the
Council on Health Boards and the HPSP Committee.
ü
The license of Patrick Corrick was revoked and a
check for $17500 was received as payment of civil penalties.
Based
on recent experiences, the Board wishes to advise practitioners that they
should seriously consider the impact of their reporting obligations. Misguided “loyalty” may have inadvertently
allowed practitioners to sink further into poor judgment and poor practices
until the level of violations have become serious. The Board would like to
remind you that loyalty to your patients should always supersede “loyalty” to
another practitioner. The only way to
avoid being an accomplice, and subjecting yourself to possible violations, is
to report violations to the Board. This
must be done in writing and forms are available from the web site or from the
Board staff. The name of complainants
will be kept anonymous if requested.
