LICENSE RENEWALS ARE DUE DECEMBER 31, 1998

 

All Renewals need to be postmarked or hand delivered to the MBCE by December 31, 1998.

Failure to renew by December 31, 1998, will result in a $150 late fee per month or portion of a month.

Continuing Education Units are not required for this renewal.

Please fill out and return the Rural Health Survey with your renewal.

RENEWAL QUESTIONS AND ANSWERS

When will license renewal material be mailed?

License renewal material has been mailed and you should have already received it. If you have not, please contact our office.

How much is the renewal fee?

The active license renewal fee is $200. The inactive license renewal fee is $150.

What are the continuing education requirements for this renewal?

There are no continuing education requirements for this renewal cycle. A complete schedule of continuing education requirements may be found on our Web site.

What about the professional boundaries/abuse requirement?

There is NOT a professional boundaries/abuse requirement for this renewal. The next eight (8) hour requirement is due by December 31, 2001.

Will the board notify me if they have not gotten my renewal by mid- to late-December?

NO. The reality is that most licensees wait until the end of December to mail in their renewal. Such a large mailing at the MBCE’s busiest time of the year is just not possible. The MBCE believes that mailing of renewal materials and publication of this newsletter should be ample enough "reminders" that renewals are due. Additionally, the MBCE expects that the renewal of a professional license would be a priority with any professional.

How can I be certain that once I put my renewal in the mail it has arrived at the MBCE office?

The best way is to send your renewal by certified mail with a "return receipt requested." This way you will receive a document with one of our staff people’s signature on it - attesting to the receipt of your renewal.

When will I receive my license certificate?

The MBCE’s policy is to mail licenses three weeks after the receipt of a renewal fee or upon completion of all renewal requirements, whichever is later. (Keep this in mind if you need to send a copy of your license to an insurance carrier in order to renew your providership.)

Is there a grace period if I don’t complete my renewal requirements on time?

NO! If your renewal requirements (application and fee) are not completed by December 31, 1998, you NO LONGER have an active license. Therefore, YOU MAY NOT PRACTICE UNTIL YOU DO!

What will happen if I forget to include part of my renewal when I mail it?

The MBCE makes every effort to mail a "letter of deficiency" within three days of receiving renewal materials if the renewal application is not complete (an item is not completed on the application form or the fee is missing). But, please understand that these letters are ONLY mailed as a response to receipt of an incomplete renewal application.

If your renewal application is complete, your 1999 license will be mailed three weeks after the receipt of a renewal fee or upon completion of all renewal requirements, whichever is later. Therefore, the earlier you complete your renewal application, the sooner you will receive your license.

OOPS! I forgot to mail my renewal. May I hand-deliver it on January 2 without paying a penalty fee?

NO. Any renewal hand-delivered on January 2 or after will be assessed a penalty fee. The MBCE has to have an absolute deadline. Therefore, if a renewal is postmarked or hand-delivered by December 31, that renewal will be on time. If the renewal is postmarked or hand-delivered January 1 or after, it will be late. Any fees received late, will be assessed a $150 penalty for each month (or a portion of a month) it is late. Penalty fees are NOT pro-rated by the number of days the renewal fee is late. As soon as the calendar turns, another full penalty fee is assessed.

The Peer Review Committee received a request for review. The following information was contained in the file.

Actual case submitted for Peer Review.

A patient’s presenting complaints: "I bruised my hip, and my lower back hurt for a couple of weeks."

Doctor’s diagnosis: "Preliminary diagnosis until further tests are completed. The patient presented with acute, moderate traumatic cervical, thoracic, cervico-brachial, thoraco-costal, lumbar, and sacroiliac radiculoneuropathy, neuro-spinal compression, intersegmental dysfunction, neurospinal facilitation and hyper-flexion/hyperextension injury with associated myofascitis, fibrositis, radiculitis, muscular spasm, paresthesia intercostal neuralgia, inter-segmental restriction of motion, restriction of motion, and muscle imbalance and dysfunction.

The diagnosis remained unchanged for more than one year.   OVERKILL? You be the judge.

Please note that to perform acupuncture, perform Independent Examination, or participate in the Graduate Preceptorship Program, you need to be registered and have active approval of the Board. Do not assume that, because you mailed in the registration form, you are approved.

PROFESSIONAL FIRMS REGISTRATION

As of January 1, 9999, Professional Corporations will cease to exist, and will be replaced by Professional Firms.

A doctor of chiropractic who wishes to incorporate their practice or provide chiropractic services under the protection of M.S. 319B, either alone or in conjunction with other professionals, must register the corporation as a Professional Firm with MBCE. This requirement is in addition to any other forms of incorporation the professional may wish to engage in. Previously, such registration was required under the Professional Corporation Act (M.S. 319A.01-22) and would not allow for interdisciplinary incorporation (incorporation with specified professionals other than doctors of chiropractic.) Recently, the professional Corporation Act was replaced by the Professional Firms Act of 1997 (M.S. 319B.01-12.) As of January 1, 1999, the Professional Corporations Act will be phased out, and the professionals will be incorporated under the Professional Firms Act. For application forms, please contact the Board Office.

If you recently filed a new application with the MBCE as a Professional Corporation, or if you have recently renewed your professional corporation, you need do nothing. The MBCE will administratively modify your registration as of January 1, 1999. Please note, however, that new requirements relating to firm names, could affect you.

CONTINUING EDUCATION CONCERNS

If you have been to a continuing education class/seminar that you feel was totally inappropriate, was clearly different from the advertised curriculum or you feel was unethical, you may submit a written complaint to MBCE. The complaint should include the title of the course, the sponsor, and your complaint. The Board will review these complaints and take appropriate action.

BOARD MEETING UPDATE

There were no actions taken by the MBCE at its September 10, 1998 meeting. Discussion included reciprocity, test development, and mission statements.

At the November 19, 1998 meeting the following actions were taken:

Approval of Mission Statement as amended.
Approval of Variance Rule as amended.
Approval of amended language for the Alternative Forms of Continuing Education as recommended by the Rules Committee.

LEGISLATIVE AUDIT

The MBCE recently participated in its regular quadrennial legislative audit, covering the period through 1997. The legislative auditor had no negative finding, in essence giving the MBCE a clean bill of health.

WE NOTE THE LOSS OF . . .

Dr. Louis Furlong, age 73, a graduate from Logan College of Chiropractic and who was licensed in Minnesota for more than 40 years.

Dr. Patrick O’Keefe, age 64, a graduate of NorthWestern Chiropractic College and who was licensed in Minnesota for more than 40 years.

Dr. Russell Tobias, age 78, a graduate of Lincoln Chiropractic College in Indianapolis and who was licensed in Minnesota for more than 50 years.

 

NOTICE

The Minnesota Board of Chiropractic Examiners is currently seeking applications for membership to its Peer Review Committee. We are seeking one public member and two professional members. The committee makes determinations of whether certain chiropractors properly utilized services rendered or ordered appropriate treatment or service, and whether the cost of treatment was unconscionable. The committee consists of seven members, including five chiropractors and two consumer members. Terms are one year in length. Members may serve two full terms. Applications may be submitted at any time and are retained and considered for two years. The committee meets on the second Tuesday of every month at 12:30 p.m. at the MBCE office.

 

BIENNIAL REPORT

The Biennial Report was submitted to the Governor’s office for 1998. This report provides detailed information regarding board activities for the last biennium. Copies may be requested by phoning our office or accessing our Web site.
