The above road map illustrates how life is really hopping here at the MBCE.  Since last June we have been faced with the threat of no budget, a state shutdown, and now a possible employee strike by AFSCME and MAPE employees.  Needless to say all this has hampered the ability of the agency to keep up with publications of the quarterly newsletter and computer improvements.  Look inside to find the status of these projects and more!

Emerging Issues  .  .  .

 

ACUPUNCTURE ONLINE RENEWAL REGISTRATION

Unlikely to be Available before September 30, 2001

 
Paper renewal forms were mailed out last August and a one-time extension of the renewal deadline was announced.  However, the web development project has taken longer than expected. 

 

Efforts continue to get the online renewal system up and running.  Consultants are in the office working diligently on the needed infrastructure, testing and implementation.  Please check the “What’s New” heading on our web site at www.mn-chiroboard.state.mn.us to verify its release date.  It is anticipated that it will be fully implemented in time for license renewals.

CONTINUING EDUCATION CREDITS
ARE DUE DECEMBER 31, 2001

 

It is expected that at or about the same time that paper renewal forms are mailed out to licensees the electronic web renewal version will be available.  Please watch for your license renewal packet for more information.

 BOARD MEETING AND DISCIPLINARY UPDATE

 The Board met on July 19, 2001 and the meeting was called to order at 9:09 a.m. with all members present.  Below is a brief summary of the events of the meeting:

 

v      Executive session yielded the following disciplinary orders:

Copies of all orders are available by contacting the Board and a list of previously disciplined doctors is available on the web site.

v      The Executive Director reported on a request for review of the policy regarding disciplinary information posted on the web; the need to reaffirm the administrative procedure policy on per diem reimbursement; a follow up review of the 2001 Legislative initiatives affecting the Board; the preliminary plans for a change in location and date of the next New Licensee Orientation (current plans have this tentatively set for December 1, 2001 at Northwestern Health Sciences University); an update on the License Transfer procedures, potential for a state shutdown; formation and update on issues relating to the Patient Exploitation/Fee Splitting Task Force; and the granting of our spending authority requested for electronic government services development.

v      The Rules Committee reported on the status of files being reviewed by the Office of Administrative Hearings and the rule on Continuing Education Non-Endorsement which was disapproved by the Governor and subsequently withdrawn from the Board’s rulemaking agenda.

v      Rosemary Kassekert who reported that this group is reviewing how cases are being handled gave the HPSP Committee report.

v      Dr. Otto, Board Vice President was congratulated on his appointment to the position of FCLB District II Director.

v      Dr. Otto reported on efforts by the NBCE to attempt to cut back on expenses and focus its efforts on computerizing prelicensure examinations.

Minn. Stat. § 148.10

LICENSES REVOKED

 

Subdivision 1. Grounds. (a) The state board of chiropractic examiners may … revoke, suspend, condition, limit, restrict or qualify a license to practice chiropractic … for:  ….  (16) Splitting fees, or promising to pay a portion of a fee or a commission, or accepting a rebate.

 

 

Advertising:  Fee Splitting

Recently, there has been a lot of interest in activities related to fee splitting, or paying a commission or a “kick-back”. The interest in this activity is not limited to the board or even this state.  Minn. Stat. 148.10 prohibits this activity.  It is clearly improper to split fees or give anything of value in exchange for the referral of a patient.  This includes fees given to the patient.  In certain circumstances, you can split fees with another chiropractor, such as in the context of a partnership or corporation, where all fees taken in are dispersed per the partnership or corporation contract.  Licensees should expect to see action taken by the Board and other law enforcement entities for violation of this statute.  In addition to Board action, there exists the possibility of imposing criminal convictions for violation of this statute.  Licensees are cautioned to be extremely careful in how they represent themselves and should be sure to contact an attorney before entering into any such agreements.

 

A Special Note on Proposed CE Non-Endorsement Rule

 The Board has withdrawn its intent to promulgate a continuing education non-endorsement rule.  However, the Board does wish to place licensees on notice that methods or procedures they elect to utilize in their private professional practice should conform to a reasonable standard of acceptable practice.  Further, in spite of where a professional may have learned a particular method or procedure and/or the fact that they may have learned or heard about a particular method or procedure in a continuing education program (albeit approved by the Board); the approval given by the Board is not intended to be used (expressed or implied) as a legal defense against prosecution or accusations of inadequate or incompetent care.

December 1, 2001 New Licensee Orientation 

All licensees interested in attending the new licensee orientation on Saturday, December 1, 2001 at Northwestern Health Sciences University are encouraged to contact the Board at 612-617-2222 and put their name on the reservations list.  The event is primarily intended to give newly licensed professionals a chance to meet Board Members, learn about the role of the Board, and network with other chiropractors.  The seminar is scheduled to run from 9:00 a.m. until noon.  The change in location will enable the Board to accept up to 100 participants at this event.  Attendance qualifies for 3 credits of free continuing education credit, however, credit will not be given for attending the event more than once.

The Board continues to work on the promulgation of several Board Rules regarding the practice of chiropractic.  The State of Minnesota has a structured rules promulgation process with specific procedures and time lines.   Please call the office or check our web site (www.mn-chiroboard.state.mn.us) for new and changing information. Or if you wish, send us a written note and ask to be placed on the ARules List@ and we will send you regular updates of the status of rules as they go through the rules promulgation process.

BOARD MEMBER VACANCY
 

This January 2002, there will be a vacancy on the board for one professional member.  For a copy of the application please check out the Secretary of State’s web site at www.sos.state.mn.us.  Board members meet monthly to serve on complaint panels, meet 5 times a year for official board meetings, and meet as needed when appointed to serve on special committee or task force assignments.  Reimbursement is a flat $55.00 per meeting (regardless of length) plus mileage.
